1. General Provisions

- These terms of use apply to all customers purchasing products through WallZap.com. By using our website and placing an order, you agree to these terms.

- WALLZAP reserves the right to update these terms as necessary. The latest version will always be available on our website. The version of the terms of use that applies to an order will be the version in effect at the time of purchase.

2. Products and Pricing

- WALLZAP specializes in selling innovative display solutions, including 3D Metal Posters, Wall Mounting Kits, Box Locks, and related accessories for board games and collectibles, some crafted in collaboration with artists.

- Prices displayed on the product pages and cart represent the product price only. Shipping costs, taxes, and duties are calculated and displayed at checkout. For EU customers, all applicable taxes and duties are included in the total price (DPP). For customers outside the EU, estimates for duties and taxes (DAP) are provided during checkout, but final charges may vary based on local customs evaluations and regulations.

- These costs are estimated based on standardized metrics, including HS tariff codes, product category, weight, and destination country regulations. However, final charges are determined by local customs authorities and may differ from estimates.

- All product prices listed on our website are subject to change without prior notice. However, the price at the time of purchase will be honored for any confirmed orders.

3. Orders and Payment

- Orders can be placed through our website. A contract is formed when payment is received, and an order confirmation is sent via email.

- Payments can be made using the payment options available at checkout, including but not limited to credit cards, Shopify Pay, and Google Pay. Available payment methods may vary by region and are subject to change without prior notice.

- WALLZAP strives to ensure a smooth ordering process, but we cannot be held liable for technical errors or interruptions caused by external factors, such as internet outages, payment gateway issues, or user-side technical difficulties. 4. Returns and Refunds

- Returns are accepted for all WALLZAP products within 30 days of delivery. Products must be unused, in their original packaging, and include all components.

- To initiate a return, customers must email us at hello@wallzap.com with the subject line "Return - [Order Number]." We will then provide a prepaid return shipping label.

- Once the returned item is received and inspected, we will process a refund within 14 days. The refund will be made using the same payment method as the original transaction, minus the cost of return shipping, which will be deducted from the refund amount.

- Returns that do not meet these conditions may be rejected or subject to a restocking fee.

- Defective products or items that do not conform to the sales agreement are eligible for a full refund, including return shipping costs.

5. Shipping and Delivery

- WALLZAP ships to most countries worldwide. Shipping costs and estimated delivery times are provided during checkout.

- Customers are responsible for providing accurate shipping information. WALLZAP is not liable for delays or additional costs due to incorrect or incomplete addresses.

- Delivery times are estimates and may vary due to external factors, such as customs processing or courier delays.

6. Intellectual Property and Artwork Responsibility

- All artworks featured on WALLZAP products are created and submitted by independent artists. The artists warrant that they hold all necessary rights to their submitted artworks and that the use of these artworks by WALLZAP does not infringe on any third-party rights, including but not limited to:

  • Copyrights or trademarks held by other entities or individuals.

  • Rights to images, logos, or other materials included in the artworks for which the artists do not have explicit permission to use.

- The artists guarantee the following:

  • All artworks are original creations, or the artists have obtained the necessary permissions to use and license them.

  • If the artworks include identifiable individuals, properties, or third-party assets, the artists confirm they have secured the required releases and permissions.

  • The artworks do not include unauthorized use of copyrighted material or infringe on any third-party rights.

- WALLZAP is not liable for any claims, damages, or legal actions arising from the use of submitted artworks. The artists agree to indemnify and hold WALLZAP harmless against any claims or expenses (including legal fees) related to intellectual property disputes or rights violations.

7. Liability

- WALLZAP is not liable for improper installation or use of any products, including but not limited to 3D Metal Posters, Wall Mounting Kits, or Box Locks. Always follow the provided instructions to ensure correct usage.

- All WALLZAP products include a QR code linking to the corresponding instruction manuals. If the instruction manual is missing or the QR code is non-functional, customers are responsible for accessing the manuals directly via our dedicated manual folder at https://drive.google.com/drive/folders/1SZ1mTRcleo-Bbd2p3JABSUll6U9IEg6S?usp=drive_link or by contacting us at hello@wallzap.com.

- Instruction manuals are provided exclusively in English. By completing a purchase, customers acknowledge and agree that they can understand and follow the English-language instructions. WALLZAP is not liable for damages or improper installation due to language comprehension issues.

- WALLZAP’s liability is limited to the purchase price of the product in cases of defects or non-conformity with the sales agreement.

8. Dispute Resolution

- These terms of use are governed by Swedish law. Any disputes arising out of or in connection with these terms shall be resolved in Swedish courts.

- According to EU Regulation No. 524/2013, customers within the European Union have the right to resolve disputes concerning online sales or service contracts out-of-court via the EU Online Dispute Resolution (ODR) platform. - For customers in the United States and other countries outside the EU and UK, WALLZAP complies with applicable local consumer protection laws and encourages customers to contact hello@wallzap.com to seek resolution before pursuing legal action. Where local laws provide alternative dispute resolution or mediation options, customers are entitled to use those as permitted by their jurisdiction.

- Disputes concerning products delivered outside Sweden may also be referred to local consumer protection bodies or ombudsmen, as applicable under local law.

- These provisions aim to ensure fair resolution processes globally. However, where local consumer protection laws in the customer’s country of residence provide additional rights or remedies, those will take precedence.
